General terms of sale.

The terms that apply to every order placed with Amarchy for the supply and installation of tiles, wood joinery or a bespoke kitchen, or for renovation work.

1. Purpose and scope

These general terms of sale (the ‘Terms’) govern the contractual relationship between AMARCHY (RC 131873 · IF 48537445 · ICE 002705591000034), hereinafter ‘Amarchy’, and any customer, whether a private individual or a professional, for the supply of materials (tiles, stone, wood, hardware), the manufacturing of bespoke pieces (kitchens, wardrobes, dressing rooms, doors, cladding) and the carrying out of installation, renovation and finishing work.

Any order implies unreserved acceptance of these Terms, which prevail over any other document of the customer, unless special conditions have been expressly accepted in writing by Amarchy.

2. Quote

Amarchy draws up a free, detailed quote following a visit to the showroom, a phone call or a site visit. The quote specifies the nature of the services, the materials selected, the quantities, the unit prices excluding tax, the applicable VAT rate, the total amount including tax, the payment terms and the estimated lead times.

The quote may be sent by email, by WhatsApp or via a secure link. The quote is accepted by handwritten signature, by online acceptance (the ‘Bon pour accord’ statement on the quote page) or by payment of the deposit, which constitutes acceptance.

Any change requested after acceptance (a change of material, surface area or layout, or an additional service) gives rise to a supplementary quote or to a new version of the quote, which replaces the previous one.

3. Validity

Unless it states otherwise, the quote is valid for 30 days from its date of issue. After that period, Amarchy reserves the right to update its prices, in particular according to the availability of materials and changes in supplier prices.

Prices are stated in Moroccan dirhams (MAD). The materials displayed in the showroom or on the website are indicative references: the natural shades of stone, marble, zellige and wood may vary from one batch to another, and this does not constitute a defect.

4. Order and deposit

The order becomes firm on receipt of the following:

  • The accepted quote (signed or approved online).
  • A deposit of 40% of the total amount including tax, which triggers the ordering of the materials and, for bespoke pieces, the start of manufacturing.

The balance is paid according to the payment schedule shown on the quote: as a rule, an interim payment as the work progresses, then the balance on handover. Payments are made by bank transfer, cheque or cash within the legal limits.

Materials ordered specifically for the customer (made-to-order tiles, wood species, cut-to-size worktops, bespoke fronts) can be neither returned nor exchanged. In the event of cancellation after order processing or manufacturing has begun, the deposit is retained by Amarchy as compensation, without prejudice to any costs incurred beyond that amount.

5. Lead times

The delivery, manufacturing and completion times shown on the quote are given for guidance only. They run from receipt of the deposit, final approval of the plans and the site being made available by the customer (substrates ready, access, water and electricity supply).

A delay cannot give rise to cancellation of the order, penalties or damages, in particular in the event of a supply delay, bad weather, a change requested by the customer, preliminary work not completed by other trades, or force majeure. Amarchy informs the customer of any significant change to the schedule.

6. Carrying out the work

The customer undertakes to provide an accessible and cleared site, to supply the relevant plans and technical information (utilities, water points, electricity) and to report any particular constraint. Preparatory work not included in the quote (strip-out, levelling, substrate repairs, alterations to utilities) is priced separately.

Amarchy carries out the work with its own teams of tilers and joiners and may call on qualified subcontractors for certain work packages, for which it remains responsible. The customer or their representative is invited to review progress at the key stages set out in the quote.

7. Handover

On completion of the work, a joint handover inspection is held. Any reservations are recorded in writing and remedied by Amarchy within a reasonable time. If the customer is absent on the agreed date, or if the premises are used without any reservation being raised, the work is deemed to have been accepted without reservation.

Handover marks the starting point of the warranties and makes the balance payable.

8. Warranty

Amarchy warrants that the work complies with good trade practice and with the accepted quote. Bespoke pieces (kitchens, wardrobes, doors, cladding) and installation work carry a 2-year contractual warranty from handover, covering manufacturing and workmanship defects. The materials are also covered by the warranties of their manufacturers.

The warranty does not cover: normal wear and tear, natural variations in shade and in veining or grain, impacts, scratches and stains resulting from use, water damage and leaks not attributable to the work of Amarchy, or defects resulting from a lack of maintenance, intervention by a third party or alteration of the substrates or of the work by the customer.

Any warranty claim must be sent in writing to Amarchy, which carries out an inspection visit before any remedial work.

9. Retention of title

The materials and pieces delivered remain the property of Amarchy until the price has been paid in full. Risk passes on delivery to the site.

10. Late payment

Any late payment automatically gives rise, once a formal notice has remained without effect for 8 days, to late-payment interest at the legal rate in force and to the suspension of the work in progress until the outstanding amount is paid.

11. Personal data

The data collected in connection with the quote and the work is processed in accordance with the Amarchy Privacy Policy and with Law No. 09-08.

12. Disputes

These Terms are governed by Moroccan law. In the event of a disagreement, the customer and Amarchy shall endeavour to reach an amicable solution within 30 days of the written complaint. Failing agreement, the dispute shall be brought before the competent courts of Rabat.
